Terms of Use

Introduction

Welcome to Tidova. By downloading and using the Tidova mobile application ("the app"), you accept these terms of use ("Terms"). If you do not accept these terms, please do not use the app.

1. Acceptance of the terms

By using the Tidova app, you declare that you have read, understood and agreed to be bound by these terms of use. If you use the app on behalf of a company or entity, you declare that you have the authority to bind that entity to these terms.

Tidova and all of its elements (design, text, graphics, logos, source code, data) are the exclusive property of Tidova or its partners and are protected by intellectual property laws. You have no rights to these elements other than the right to use them in accordance with these terms.

5. Tide data

The tide data provided by the app comes from official sources (SHOM, NOAA, FES2022) via the TidesAtlas API. Although we strive to provide accurate and up-to-date data, we do not guarantee the accuracy, completeness or reliability of this data. Use of the tide data is at your own risk.

6. Premium subscription

6.1 Subscription plans

Tidova offers the following subscription plans:

6.2 Renewal and cancellation

The monthly and yearly subscriptions renew automatically at the end of each period. You can cancel your subscription at any time from the App Store settings (iOS) or Google Play (Android). Cancellation takes effect at the end of the current period.

6.3 Refund policy

iOS: Refund via Apple within 14 days of purchase.
Android: Refund via Google Play within 48 hours.
Lifetime purchase: Refundable within 14 days, non-refundable thereafter.

6.4 Price changes

Launch prices are guaranteed for early adopters. Any price increase will be communicated 30 days in advance via an in-app notification. Holders of a lifetime licence are never affected by price changes.

7. End-of-service policy

In the event that the app is removed from the stores or permanently discontinued, the following policy applies:

7.1 Notice

A minimum of 90 days' notice will be given to users before the service is discontinued. This notice will be sent via an in-app notification and by email if available.

7.2 Monthly and yearly subscribers

No further charges will be made after the date the discontinuation is announced. Current subscriptions will not be renewed. Users will retain access to the service until the end of the current period.

7.3 Lifetime buyers

If the service is discontinued less than 3 years after the purchase of a lifetime licence, a partial refund will be calculated pro rata to the remaining duration:

Refund = €100 × (36 − months elapsed) / 36

If the discontinuation occurs 3 years or more after purchase, no refund will be due.

7.4 Data export

A tool to export favourites will be made available during the notice period to allow users to retrieve their data.

8. Limitation of liability

To the maximum extent permitted by applicable law, Tidova shall not be liable for any direct, indirect, incidental, special or consequential damages arising from the use of, or inability to use, the app, including but not limited to: loss of profits, loss of data, business interruption, or any other pecuniary loss.

9. Indemnification

You agree to indemnify and hold Tidova harmless from any liability arising from your use of the app in breach of these terms or of any applicable law.

10. Termination

Tidova reserves the right to terminate or suspend your access to the app at any time, without notice, in the event of a breach of these terms or for any other reason deemed necessary.

11. Changes to the terms

Tidova reserves the right to modify these terms of use at any time. Changes will be published on this page with a revised update date. Continued use of the app after the changes are published constitutes your acceptance of the new terms.

12. Governing law and jurisdiction

These terms are governed by French law. Any dispute relating to these terms will be submitted to the competent French courts. If you use the app as a consumer, you retain the benefit of the mandatory consumer protection provisions of your country of residence and the right to bring proceedings before the courts of that country.
